Plaintiff allowed to seek punitive damages in employment sexual discrimination case

California's Silicon Valley region is home to several of the most successful and profitable tech companies in the world. While the region and its many millionaires are used to being covered in the news, more recently the region has received attention for very different reasons as concerns about widespread sexual discrimination have surfaced.

Depression: ADA protections and employment discrimination

According to the National Institute of Mental Health, during 2012, nearly seven percent of U.S. adults reported suffering "at least one major depressive episode in the past year." For individuals who struggle with depression; feelings of overwhelming sadness and hopelessness may persist for weeks, months or even years. Many Californians have likely heard statistics related to the fact that, on average, female U.S. employees earn 78 cents for every dollar earned by a man. According to information from the American Association of University Women (AAUW), this disparity in wages is even more pronounced for women of minority groups with Hispanic women earning only "54 percent of white men's earnings." Additionally, the wage gap appears to widen with age with working women age 35 and older earning less than their younger counterparts when compared against the salaries of men.

The United States has long upheld itself as a cultural melting pot. However, in recent years some contend the pot is nearing its boiling point as conservative politicians and media outlets continue to take aim at immigrants and minority groups. Prior to the 1960s, many U.S. women did not pursue career opportunities outside the home. Fast forward 50 years and things have changed considerably and today more than 57 percent of women age 16 and older work outside the home. In fact, according to the U.S. Department of Labor, as of 2013 more than 127 million women age 16 and older were part of the American workforce.

Legal protections afforded to employees with physical and mental disabilities

According to the Pew Research Center, an estimated 27 percent of Americans age 18 and older have a physical or mental disability that "interferes with activities of daily living." Whether an individual is born with a physical or mental disability or a disability is the result of a later-in-life injury or medical condition, many disabled adults experience challenges in both attaining and retaining jobs.
